1.This competition is a promotion run by Realmark North Coastal Pty Ltd ABN 25 158 950 255 ("Promoter").
2.Entries and information on prizes and how to enter form part of these terms and conditions. Entries not completed in accordance with these Terms and Conditions are ineligible.
3.Employees and immediate family members of the Promoter, associated companies and related entities of the Promoter are ineligible to enter.
4.The competition commences 1st December 2017 and closes 5:00pm AWST 5th January 2018.
5.There will be one winner in this competition who will be chosen at random from all eligible entries.
6.Each individual may only enter the competition once.
7.All other expenses are the responsibility of the winner. Prizes are subject to the standard terms and conditions of individual prize suppliers. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize.
8.The Promoter reserves the right to substitute with an alternative prize of equal or greater value.
9.Except as otherwise stated in these terms and conditions, the prize is not transferable, exchangeable or redeemable for cash.
10.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
11.The Promoter reserves the right to amend, cancel or suspend this competition if an event beyond their control occurs without notice.
12.Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
13.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
